Extensions for: IMU, electronic prescription, dehors, columns for electric vehicles, safety and fire prevention measures for school buildings. From Anci the extensions of interest to the Municipalities
The Milleproroghe law decree received the go-ahead from the Government: on December 21 the Council of Ministers, on the proposal of the President Giorgia Meloni, approved the text. Publication in the Official Gazette is now awaited.
The provision contains a series of extensions of the legislative terms concerning all citizens in terms of:
- public administration,
- economy and finance,
- education and university,
- labor and social policies,
- infrastructure and transport,
- companies and made in Italy,
- foreign affairs and international cooperation,
Below is a summary of the general extensions and those of specific interest for the Municipalities with the first summary note of the Anci, of which we underline the extension of the term for the award of “zerosei” school building interventions and the terms for the commissioning fire regulations for educational and school buildings.
Milleproroghe law decree: brief summary of the extensions
The provision, containing urgent provisions on legislative deadlines (decree-law), affects various sectors: from healthcare to new tax deadlines, authorizations for removable structures on public land and more.
Below are some of the most important provisions envisaged, concerning businesses and households.
Certain authorizations have been extended regarding the assumptions already adopted for the Public Administrations.
For the year 2023, the use of the solidarity fund is authorized, resources allocated by the 2022 budget law with a total budget of 10 million euros for the year 2022, aimed at disbursing a contribution to the owners of units residential properties that cannot be used due to illegal occupation.
The validity of driving licenses issued by the United Kingdom to residents of Italy has been extended to 31 December 2023.
Economy and finance
The deadline for submitting the application has been postponed from 31 December 2022 to 30 June 2023 IMU declaration relating to the 2021 tax yearby both public and private, non-commercial entities (welfare, social security, health, scientific research, cultural, recreational, sporting, religious, trust, OICR).
The system of exemption from the obligation of electronic invoicing by health professionals required to send data to the health card system is also extended for 2023.
Postponed from 1 January 2023 to 1 January 2024 the deadline for the application of the obligation to send data relating to the transactions carried out on each day, to the global amount of the considerations for taxable transactions and to the related taxes exclusively through technological tools that guarantee the inalterability and security of data, including POS.
With regard to tenders for the assignment of substitute canteen services rendered by means of “meal vouchers”, the current criterion of the most economically advantageous offer remains valid until the date of acquisition of the effectiveness of the new Code of public contracts and, in any case, no later than 30 June 2023.
The exemption from stamp duty for the certification of personal data electronically ensured by the Ministry of the Interior through the national registry of the resident population is also extended to 2023.
The effectiveness of the provisions on the use of electronic prescriptions is extended until 31 December 2023.
Education and university
An additional two months were granted to local authorities for the award of the works and the achievement of the objectives of the PNRR, in compliance with the European milestone set for 30 June 2023.
In particular, it concerns the standard required by the ANCI regarding the awarding of works for the safety, restructuring, redevelopment or construction of buildings owned by the Municipalities intended for nursery schools and kindergartens and multifunctional centers for services to the family: the Milleproroghe decree provides for a postponement from 30 March to the end of May for theawarding of tenders concerning projects for new nursery schools.
Public land use
The possibility has been postponed for 6 months for public establishments holding concessions or authorizations concerning theuse of public landto place furniture and structures on site temporarily, without prior authorisation, on streets, squares, streets and other open spaces of cultural or landscape interest.
The authorization simplification is valid until 30 June 2023 and concerns the following removable structures functional to the activity of the businesses themselves:
- street furniture elements,
- coffee tables,
- chairs and umbrellas.

Labor and social policies
The mechanism of the “expansion contract” is extended until 2025, the support to companies in financial crisis that vary a corporate reorganization and favor the early retirement of employees, which was previously foreseen until 2023.
- The intervention which provides for the hourly reduction and wage integration for certain categories of workers has also been extended, also for the years 2024 and 2025 in favor of companies that employ over 50 employees, for a period not exceeding 18 months, even non-continuous ;
- the suspension of the statute of limitations of the contribution obligations relating to the social security management of public employees has been extended to 31 December 2023 and the deadline by which the public administrations that have established co.co.co relationships are required to pay contributions for separate management;
- extended for the whole of 2023 the competence attributed exclusively to labor consultants and to the comparatively more representative employers’ associations as regards the verification of the requirements concerning the observance of the provisions of the collective labor agreement and the congruity of the number of entry requests of non-EU citizens.
Infrastructure and transport
The driving ban for i motor vehicles of categories M2 and M3used for local public transport services, fueled by petrol or diesel with Euro 2 anti-pollution characteristics.
Environment and energy security
The deadline for the redefinition of contaminated sites of national interest has been extended.
Companies and Made in Italy
The duration of the allocation of 40 million euros for the disbursement of contributions for theinstallation of columns for charging electric vehicles.
With regard to tax credits, given the difficulties in procuring raw materials, the deadline for the delivery of material capital goods purchased by 31 December 2022, always on condition that the relative order is accepted by the seller and that a deposit of no less than 20% of the agreed amount has been paid.
Foreign affairs and international cooperation
The application of special support measures in derogation (non-repayable co-financing) in favor of companies that export or have branches or subsidiaries in Ukraine, in the Russian Federation or in Belarus is extended to 31 December 2023 and the possibility of accessing co-financing at grant, in favor of exporting companies, in order to deal with the negative impacts on exports.
The deadline set for the preliminary fulfillment of the elections for the renewal of the members of the Military Judiciary Council has been postponed to 30 September 2023.
The legislative term relating to the expiry of existing contracts stipulated by the Presidency of the Council of Ministers with the press agencies for the purchase of journalistic and information services has been extended to 31 December 2023.

The first Anci synthetic note
Anci, the National Association of Italian Municipalities, has published the first summary note about the rules of interest to the Municipalities, contained in the Milleproroghe decree approved by the Council of Ministers on 21 December last.
The document highlights some measures of interest to the Municipalities, including:
- extension of deadline for hiring social workers,
- derogation from the non-assignment of tasks to members of regional and local political bodies,
- extension of the deadline for the award of zero-six school building interventions,
- deadlines for bringing educational and school buildings into compliance with fire regulations,
- support for public exercises,
- regularization of INPS contribution positions.
Based on what was requested by the Anci, the decree extends the maximum deadline now set to 31 March 2023 to 31 May 2023 for the award of the safety measures, restructuring, redevelopment or construction of nursery schools and kindergartens referred to in paragraph 59, law n. 160/2019, included in the PNRR, thus allowing the local authorities benefiting from the loans to actually implement the interventions, also in consideration of the long time frame recorded from the publication of the rankings to the signing of the loan concession agreements. The progress of the Pnrr projects for nursery schools and kindergartens is in fact entrusted to the implementation of the local authorities.
Fire prevention school buildings
Pursuant to the new request from the ANCI, it differs as at 31 December 2023 the deadlines set for fire safety compliance in order to allow local authorities to use these resources also for fire prevention adaptation.
